Terms of Use
Last updated 24 September 2026
These terms form a contract between you and Kazuya Yemi Kai-Olowu, a sole trader established in the United Kingdom and trading as HeyShima, of Prime Apartments, 483 Green Lanes, London N13 4FG, United Kingdom ("we", "us", "our"), and govern your use of the HeyShima mobile application and heyshima.com (together, "the Service"). By using the Service you agree to them. If you do not agree to them, do not use the Service.
Nothing in these terms affects your statutory rights as a consumer.
- Licence. We grant you a personal, non-exclusive, non-transferable, revocable licence to use the Service for your own learning. You may not redistribute, resell, sublicense, or reverse-engineer the Service or its content, except to the extent that such a restriction is prohibited by applicable law, or where an item of third-party content is licensed to you directly on terms that permit it (see clause 7).
- Eligibility. The Service is for users aged 13 and over, or 16 and over in any country where 16 is the age of consent for information society services. You must not create an account if you are below the applicable age. Where we become aware that an account holder is below it, the account and the data held with it will be deleted.
- Accounts. Part of the Service is available without an account. An account is required for the remainder. You are responsible for activity carried out under your account and for keeping your sign-in credentials secure. You may delete your account at any time within the Service.
- HeyShima Pro. Some content requires a HeyShima Pro subscription or a one-off lifetime purchase, bought through Apple's In-App Purchase and billed to your Apple account.
- Prices are displayed in the Service before purchase and may vary by country.
- Subscriptions renew automatically for the same period and at the same price until cancelled. Cancellation is made in your Apple account settings at least 24 hours before the end of the current period.
- Where a free trial is offered, it converts to a paid subscription at the end of the trial period unless cancelled before then.
- A lifetime purchase is a single payment and does not renew.
- Purchases are made from Apple, and refunds are administered by Apple under its terms. Where you are a consumer in the United Kingdom or the European Economic Area, your statutory right to cancel a distance contract within 14 days is unaffected by these terms; because digital content is supplied immediately, that right may be lost once supply begins with your consent and your acknowledgement that it will be lost.
- Deleting your HeyShima account does not cancel a subscription.
- Acceptable use. You must not: use the Service unlawfully or for any unlawful purpose; attempt to gain unauthorised access to the Service or to any account, system or network connected to it; interfere with or disrupt the Service, including by placing unreasonable load on it or by circumventing rate limits or access controls; submit content through the feedback facility that is unlawful, abusive, or designed to disrupt; scrape, harvest or bulk-extract content from the Service; or use the Service to develop a competing product.
- Suspension and termination. We may suspend or terminate your access to the Service, in whole or in part, where you are in material breach of these terms, where we are required to do so by law, or where suspension is reasonably necessary to protect the Service or its users. Except where doing so would be unlawful or would compromise the purpose of the suspension, we will give notice and, where the breach is capable of remedy, a reasonable opportunity to remedy it. You may stop using the Service and delete your account at any time.
- Content and attribution. The Service includes third-party data and media provided under open licences, including dictionary data © EDRDG, stroke data © KanjiVG / Ulrich Apel under CC BY-SA, vocabulary audio © Tofugu LLC under CC BY-SA, a synthesised kana voice from VOICEVOX: 玄野武宏, and the Klee One typeface under the SIL Open Font Licence. Those items are licensed to you directly by their respective licensors on the terms of those licences, and to the extent that any such licence grants you rights that clause 1 would otherwise restrict, that licence prevails. Full credits are on our Licences and credits page and within the Service.
- Availability. We aim to keep the Service available but do not warrant uninterrupted or error-free operation. We may modify, suspend or withdraw features, and will give reasonable notice of any change that materially reduces the functionality of a paid subscription. You are responsible for retaining your own copies of any material you wish to keep.
- Consumer rights and warranties. Where you are a consumer, digital content supplied to you must be of satisfactory quality, fit for purpose and as described under the Consumer Rights Act 2015, and nothing in these terms excludes or limits those rights or any other right you have that cannot lawfully be excluded. Subject to that, and to the extent permitted by law, the Service is provided without further warranties, whether express or implied.
- Liability. Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot lawfully be excluded or limited. Subject to that:
- we are not liable for loss that was not foreseeable, for loss of profit, revenue, business, goodwill or anticipated savings, or for loss or corruption of data to the extent that it results from your failure to keep your own copies; and
- our total liability arising out of or in connection with these terms and the Service, whether in contract, tort (including negligence), breach of statutory duty or otherwise, is limited to the greater of the amount you paid us in the twelve months before the event giving rise to the claim, and £100.
- Changes to these terms. We may amend these terms where there is a valid reason to do so, including to reflect a change in the Service, in our costs, or in applicable law or regulation. We will give at least 30 days' notice within the Service of any amendment that materially affects your rights or obligations, other than a change required by law that must take effect sooner. If you do not accept an amendment, you may stop using the Service and delete your account before it takes effect; where you have paid for a subscription and the amendment is materially to your disadvantage, you may cancel and request a refund of the unused portion through Apple.
- Governing law and jurisdiction. These terms and any dispute arising out of them or their subject matter are governed by the law of England and Wales. The courts of England and Wales have exclusive jurisdiction, except that if you are a consumer resident elsewhere in the United Kingdom or in the European Economic Area, you retain the benefit of any mandatory protections of the law of your country of residence and may bring proceedings in its courts.
- General. If any provision of these terms is held to be unenforceable, the remaining provisions continue in force. Our failure to enforce a provision is not a waiver of it. You may not assign your rights under these terms; we may assign or transfer ours to a company we incorporate to carry on the business, or to a person acquiring the business, provided that doing so does not reduce your rights. A person who is not a party to these terms has no right to enforce them under the Contracts (Rights of Third Parties) Act 1999. We are not liable for failure to perform caused by events beyond our reasonable control. Clauses 7, 9, 10, 12 and 13, and any other provision intended to survive, continue to apply after these terms end. These terms, together with the Privacy Policy, are the entire agreement between us in relation to the Service.
